1. Agreement to Terms
By accessing or using GoldSaarthi (the "Service"), you agree to be bound by these Terms of Service. The Service provides cloud-based inventory, POS, and billing solutions for gold and jewellery businesses. You must be at least 18 years old and legally authorised to enter into these terms on behalf of your business.
2. Use of License
We grant you a revocable, non-exclusive, non-transferable, limited license to use the platform in accordance with your selected pricing tier. You may not:
- Modify or copy the materials or the software architecture.
- Attempt to decompile or reverse engineer any software contained on GoldSaarthi.
- Transfer the materials to another person or "mirror" the materials on any other server.
- Share accounts beyond the permitted employee count of your billing tier.
3. Accuracy of Accounting & Compliance
GoldSaarthi provides automated calculations for GST, making charges, purity, and old gold deductions based on the parameters set by you. You are solely responsible for the accuracy of these parameters and ensuring that your invoices and tax reports comply with Indian tax laws (GST) and the Bureau of Indian Standards (BIS/HUID). GoldSaarthi acts only as a facilitation tool and does not provide legal or financial advice.
4. Live API Rates
Our platform fetches live 24K, 22K, 18K, and Silver rates through third-party APIs. We provide this data "as is" and do not guarantee real-time accuracy. Always verify rates before finalising large business transactions.
5. Limitation of Liability
GoldSaarthi shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total aggregate liability shall not exceed the amount paid by you in the three months preceding the event giving rise to the claim.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.
7. Dispute Resolution
In the event of a dispute, you agree to first contact us at contact@goldsaarthi.com to seek resolution. If not resolved within 30 days, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Maharashtra, India.
8. Modifications
GoldSaarthi may revise these Terms at any time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes constitutes your acceptance of the new Terms.
